    Q
    Access rules changed in Basic-fit
    Consumentenrecht / Consumer Law

I have a 1 year membership with basic-fit. To access the gym you scan a qr code on your phone app. Previously you can scan and re-enter after 1 hour but now it has been increased to 3 hours.

I go to the gym for about 45 minutes then I have to step out to take care of some matters but I'm back within an hour to finish my exercise, with the new change from 1 hour to 3 hours reentry that has become impossible.

I tried speaking to customer service but no luck. Any idea if I have a right to cancel the contract?

    A
I don't think this rule is the exact contractual obligation designed for you. It specifically is designed not for you. In the sense that you have a contract, and by that nobody else should access the gym on your card. Basic fit being budget, they do not have an employee stationed at the entrance, so pre programmed scanning device checks the validity of your card. And that is the crux: it validates your card. It does not validate you.

To combat abuse of students just passing around the same card, the system simply blocks re-entry for a period as it is deemed unlikely that someone would leave and want to re-enter the gym shortly thereafter. Unrealistic. In most cases. But it does up the burden for friends and families to just pass the card around.

However, that should not be your issue. You have access to the gym. You have a card. You have a contract. That their method is "onze size fits all", and it does not fit you, should not be your problem to begin with. You can perfectly indicate it is you, with your card, and a valid contract.

Simply ring the bell and wait for an employee to show up. File a complaint if you want. I doubt this is severe enough for a full contract cancellation.

Mbt. jouw tweede punt, volledig akkoord.

Jou manier is uiteraard beter toch??

The emblematic American chain Gold's Gym, which belongs to RSG Group, will debut in 2025 with two gyms in the province of Barcelona. The master franchise is looking for investors to accelerate its expansion.

RSG Group will return to Spain a few months after announcing its total divestment with the sale of McFIT to Basic-Fit. The German group will have a presence in the country again at the beginning of 2025, but it will not be carried out with any low-cost brand, but with another medium-priced one, Gold's Gym, one of the oldest gym chains in the world. The master franchise that has acquired the rights to exploit the brand in Spain plans to invest between 40 million and 50 million euros in its development over the next decade.

Ignacio Barbancho leads the pool of businessmen who will be in charge of this project. He has a career of more than two decades in the sports and health sector, with experience in Toral Clinic, Playoff Consulting, Parc del Garraf Sport AIE, DiR or the Real Guadalhorce Club de Golf, among others. A year ago, he and his partners travelled to one of RSG Group's centres in Berlin, where they acquired the right to expand the brand in Spain. Months later, the master franchise has already signed its first location and the second very late, both in the province of Barcelona.

The company plans to invest around 2 million euros in each establishment and will debut in Terrassa (Barcelona), with a space of 3,600 square meters. The venue will have a large fitness room of more than 1,500 square meters and a car park. "We hope that it will be one of the reference gyms in this city, where we believe we can have a great fit," Barbancho explains to 2Playbook. The centre where it will be located was occupied until a few months ago by a Mercadona supermarket, which moved to another busier location. This point is not trivial, as the master franchise has begun to draw alliances with different firms in the real estate sector to be able to access large premises.

"Our development plan is different from that of a conventional chain: we do not seek to grow through agreements with real estate agents (API), but we have built partnerships with real estate projects under development, where hotels and homes will be built, and also with supermarkets with interesting locations, so that when they leave we can enter. This will allow us to access premium locations without entering into rental wars," says Barbancho.

In addition to the project in Terrassa, which will begin work in a few weeks, in 2025 it will also inaugurate another in the same province. "We hope that it will be our flagship in the Barcelona area. It will have 5,000 square meters, of which 3,800 square meters are useful, the rest parking," says the company's head in the country. Its expansion will not end here, as it is in advanced negotiations to acquire two locations in Madrid, as well as others in Bilbao and Murcia.

Its intention is to open between 20 and 25 clubs of its own in the next decade. Its growth will be organic, as it rules out expanding through purchases, although it opens the door to finding financial partners. "We started with our own resources, but we are open to investment funds to accelerate growth, although at a pace that does not stress us," he says.

Closer, for the moment, seems to be the other option it is contemplating, finding franchisees willing to develop the brand in certain territories. In fact, it is already in talks with investors interested in this option, with which its roadmap could be expanded to 40 locations. "We will do it in dribs and drabs, since we only want to work with people who provide the capital and we are the ones who assume the management," says the executive.

Its objective is to reach a ratio of 1.5 members per square meter, until it reaches between 3,000 and 4,000 users. "We want spaces where there is no saturation of users or lack of space," he adds. Regarding the price, Barbancho clarifies that it will vary depending on the location. "The real estate market limits us, as does the amount of equipment that we end up incorporating into each premises," he says.

"Spain is a very competitive market, with brands that do it well. We know the market well and the few opportunities that may remain. At the moment we are looking for locations where we can have little competition, although we trust in the differential value of the brand and its product," reflects the head of the master franchise in Spain. This, in fact, will not be the only country in which it will grow in the coming months. "RSG Group is very active selling contracts throughout Europe, it will also enter France," he anticipates.

The arrival of Gold's Gym in Spain, in fact, was already close to materializing in 2021, as 2Playbook advanced. RSG Group acquired the U.S. chain in 2020, when it was going through an economic bankruptcy process due to the pandemic. Since then, it began to pilot its expansion in Europe, proposing Italy, Germany and Spain as its first destinations. The expansion in the Iberian Peninsula was planned through its own gyms that depended on the German group and franchises.

Schaller's death in 2022, however, modified the plans of the group, which a few months earlier had exported another of its brands, John Reed, through an alliance with footballer Sergio Ramos. Its new administrators opted to focus the operations of the company's headquarters on the German-speaking markets - Germany, Austria, Switzerland and Poland - as well as the United States and some occasional incursions into strategic locations such as Milan. In the rest of the territories, its growth would be limited to franchisees. Hence, they stopped considering their presence in Spain strategic and put McFit's business in the country up for sale.

One of the particularities of the chain will be the design and distribution of its facilities. Each one will have, as a general rule, a reception with a seating area to encourage the socialization of users; a large fitness room where group classes will also be held, and a room for directed activities, as well as changing rooms.

"The look and feel has changed a lot since it was bought by RSG Group. The ceilings are high and the atmosphere is different, with more interior design. The layout is very careful and thought out, because we seek to offer a very complete experience that solves the needs of both amateur users and athletes," says the executive.

Planet Fitness, one of the fastest growing gym chains and franchises in the world and with the largest number of members of any fitness brand, has today opened the doors of its first club in the Community of Madrid, specifically in the town of Fuenlabrada. It is a totally differentiating model for the sector, which has already triumphed in other countries and which, since July, has been reaping great success in Sabadell (Barcelona). Under the slogan 'We don't judge', Planet Fitness arrives in Spain to address and end one of the great barriers to going to the gym or doing sports: bullying or shame.

Unstoppable Vivagym after a new acquisition
VivaGym has taken another step forward in its expansion with the acquisition of four gyms from the One Fit chain, which reinforces its growth strategy in the Iberian fitness sector. This operation brings it to 196 centres in Iberia, 161 of them in Spain, and brings it even closer to its goal of reaching 500 operational centres by 2030.
    ...
VivaGym, which was recently acquired by the investment fund Providence Equity Partners, continues with its expansion strategy both nationally and internationally, standing out for its accessible and flexible business model for the public.

    PF madrid;
"They don't let you use weights, take photos with your cell phone, or wear thin tank tops. Instead of a gym he looks like a psychologist. It is a gym for beginners, seniors or older people. I do not recommend it for advanced training."
