    One sector that continues to show strength in China is the online gaming space. Chinese online game company Perfect World(PWRD - Cramer's Take - Stockpickr) surprised Wall Street Monday after the firm forecasted first-quarter revenue ahead of analysts' estimates due to strong growth from new and current games. The firm expects first-quarter revenue to come in at $38.7 million to $39.8 million, vs. analyst estimates of $32.1 million. American depositary receipt (ADR) shares soared 12% higher to close at $28.60 on 3 times average daily volume.

    SHANGHAI/LOS ANGELES, Feb 26 (Reuters) - Top Chinese online gaming company Shanda Interactive Entertainment Ltd (SNDA.O: Quote, Profile, Research) posted a 22 percent rise in quarterly earnings that topped Wall Street targets, on healthy demand for its games despite a seasonally weak quarter.

    China Is Playing to Win

    What does it mean when five companies that specialize in online multiplayer games in China step up to the earnings stage, and all five far exceed Wall Street's profit expectations?

    I'll tell you. It means that the key players are growing, and it's not coming at the expense of their rivals. The same niche that hit a bump last year when the Chinese government began curbing the growth of Internet cafes, is back in the game.

    You saw it yesterday. Shares of Perfect World (Nasdaq: PWRD) soared 12% higher after the company posted stellar results. Revenue soared 325%, to $35.4 million, as a meager quarterly loss a year ago was transformed into a $0.34-a-share profit. Analysts were braced for earnings of just $0.27 a share with $29.7 million on top.

    Shanda Interactive (Nasdaq: SNDA) then took the baton and ran it all the way to the finish line last night. Earnings grew by 22%, to $0.54 a share, though non-GAAP profitability -- the metric analysts use in gauging Shanda's performance -- rocketed 68% higher to $0.58 a share. Revenue climbed by a healthy 52% to hit $97.8 million. (Rewind to the company's third-quarter earnings here.)

    The pros were also well short on Shanda, looking for an adjusted profit of just $0.45 a share on $93.5 million in revenue.

    Shanda and Perfect World are making the most of their growing assortment of established titles, expansion packs, and new games. They balance their gaming exposure by offering some flagship games as pay experiences, with other multiplayer diversions positioned to cash in when hooked players pony up for virtual accessories.

    The companies certainly know how to draw crowds. Shanda watches over 3.5 million active paying accounts, while the fast-growing Perfect World has now lapped the 1.5 million mark of active paying users.

    It was a great Monday for the niche, but it was also one that could have been easily predicted after watching peers NetEase.com (Nasdaq: NTES), Giant Interactive (NYSE: GA), and The9 (Nasdaq: NCTY) all trounce expectations.

    If I saw it coming last week, surely you must have, too.

    Five for five, my friend
    "It's time to get excited again about the online gaming industry in China," I wrote on Thursday after NetEase and Giant lapped their respective profit targets. "After a pair of blowout quarters last night from two of the five stand-alone players -- with the other three set to report over the next few trading days -- it's shaping up to be a growth market again."

    Now that we have a scorecard of all five companies, it looks like the sector is a star pupil.

    I'll confess that I'm surprised to see all five players proving that their corporate realities are far grander than Mr. Market's perceptions. I had the lingering doubt that all of this growth had to be coming at the expense of weaker players.

    Naturally, not every company is growing at the same pace. The younger Perfect World and Giant are running faster than their established peers. However, the market itself is clearly growing.

    This opens the door for even smaller players making a push in this space, like CDC (Nasdaq: CHINA) or even a stateside juggernaut like Electronic Arts (Nasdaq: ERTS), which has a play here through its minority stake in The9.

    Either way, the message is clear. It took four out of five dentists to endorse sugarless gum to get folks to chew Trident. Now you have five out of five online multiplayer fantasy game specialists in China letting you know to put your money where their virtual mouths are.

    EC to Target Holland and Greece For Gambling Restrictions

    After meeting later this week, the European Commission is expected to issue a final warning to Greece and Holland challenging their protectionist practices against foreign gambling operators, affecting online poker operators as well, to bring them into compliance with EU directives that give EU-based operators the free movement of goods and services between the 27 EU member countries, according to reports in Reuters this week.

    The European Court of Justice (ECJ) has repeatedly ruled that EU states can restrict gaming, but only in a proportionate and non-discriminatory way.

    Specifically, Commission officials will discuss the discriminatory exclusion of sportsbetting services preventing competition with state-supported monopolies in the two markets.

    Failure to comply with any final warning issued, called a 'Reasoned Opinion', could result in legal action against Greece and Holland being taken in the ECJ (Judicial Phase- see explanation of steps the EC can take below).

    Greek gaming company OPAP is an effective monopoly in its home market. It also competes with other operators in Cyprus.

    In a move reminiscent of recent Swedish delay tactics to continue lucrative monopoly revenues, OPAP was described as playing a waiting game, according to a Greek analyst in the Reuters report. "This is not really an immediate problem for OPAP," the Athens-based analyst said. "Greece has said it is arguing for OPAP to be exempt from competition, and it will take a couple of years for a final decision to be taken by the EU in any case."

    A spokesman for Commissioner McCreevy confirmed only that the Commission would discuss legal action at its meeting on Wednesday, and would reveal any decisions made on Thursday.

    OTHER VIOLATORS THE EC IS CHALLENGING

    EU Internal Market Commissioner Charlie McCreevy is overseeing legal action against 10 of the EU's 27 member states to crack down on government practices designed to protect state gaming monopolies from competition from EU-based gaming firms.

    Most recently, the European Commission took the formal legal step of issuing a formal opinion to Sweden, giving Sweden two months from January 31 to show how measures to protect the Swedish state-owned gambling company, Svenska Spel, against non-state supported poker games and tournaments are compatible with EU law (click here for related article).

    At the same time, the EC challenged Germany's new German Interstate law which came into force on January 1 that bans online gaming and betting (with the exception of horse racing). The law also bans financial institutions from processing transactions related to such 'illegal' online gambling services. Like Sweden, the EC gave Germany two months to respond to the Reasoned Opinion they issued.

    HOW THE EC PROCEEDS

    When challenging violators, the EC can proceed in three distinct stages (defined under Article 226 of the Treaty on European Union):
    # Request for Information in a Letter of Formal Notice (Member is notified of suspected breach & asked for explanations, so EC can decide if a breach exists);
    # Reasoned Opinion (EC rejects Member State's explanation & says take corrective action or face ECJ court proceedings);
    # Judicial Phase: when the Commission sues a Member State before the European Court of Justice (ECJ)

    The first step's Letter of Formal Notice is usually unknown to the public, unlike later stages, unless the Commission decides to issue a press release if it feels a case is of exceptional significance to EU citizens (as when an infringement gave rise to a large number of complaints) as has been the case with gambling.

    Despite the ever-present political risks stemming from its icy relationship with China, Taiwan has proven itself a promising yet largely overlooked destination for high-growth investors. Tech stocks like GigaMedia (Nasdaq: GIGM), AU Optronics, and Siliconware Precision Industries (Nasdaq: SPIL), for instance, have been winners over the past five years, returning 2,094%, 254%, and 377%, respectively.

    The publicly traded Taiwanese companies are generally large and tech-oriented. In fact, more than half of the iShares MSCI Taiwan Index is weighted in tech companies like Taiwan Semiconductor (NYSE: TSM). Moreover, many of these tech stocks pay dividends -- the ETF, for example, pays a 2.9% yield. Taiwan Semiconductor alone doles out 3.7%.

    Investors should also take note that presidential elections in Taiwan are expected to take place on March 22. In January, the Kuomintang party won parliamentary elections, giving the markets hope that relations between Taiwan and China would improve. Another Kuomintang party win on March 22 could make the market smile.
