    Finisar Receives $25M in Additional Post-Verdict Damages in DirecTV Patent-Infringement Case

    SUNNYVALE, Calif. (AP) -- Finisar Corp., a maker of fiber-optic systems for telecommunications products, said Friday it received $25 million in additional post-verdict damages from a Texas federal court related to a patent-infringement case against satellite broadcaster DirecTV Group Inc.

    The court decided to give Finisar the additional sum "due to DirecTV's willingful infringement." It also granted the company prejudgment interest on the jury's verdict at 6 percent compounded annually since April 4, 1999, or about $12 million.

    The court denied an injunction but ordered DirecTV to pay a compulsory ongoing license fee to Finisar at the rate of $1.60 per set-top box throughout the duration of the patent which expires in April 2012. DirecTV said 2006 sales of new set-top boxes totaled about 15 million units.

    A Texas jury initially gave Finisar $78.9 million in back damages in June. The company had accused DirecTV of infringing patents for transmission of digital information to a wide base of subscribers.

    Finisar reported $364.3 million in fiscal 2006 revenue.

    Shares of Finisar gained 20 cents, or 6.6 percent, to $3.23 in electronic premarket trading, having closed Thursday at $3.03 on the Nasdaq

    Here's a C&P of the final judgment. Note first royalty payment starts 10/7/2006. Total bucks to FNSR is $117,279,526.25.

    FINAL JUDGMENT

    Pursuant to Rule 58 of the Federal Rules of Civil Procedure and in accordance with the
    jury verdict delivered on June 23, 2006 and the Court’s oral findings and conclusions entered on the record July 6, 2006, the Court hereby enters judgment for Plaintiff Finisar Corp. and against Defendants The DirecTV Group, Inc., DirecTV Holdings, LLC, DirecTV Enterprises, LLC, DirecTV Operations, LLC, DirecTV, Inc., and Hughes Network Systems, Inc. for infringement of U.S. Patent No. 5,404,505, claims 16, 17, 22, 24, 26, 39, and 44.
    IT IS THEREFORE ORDERED that Plaintiff Finisar Corp. shall have and recover from Defendants The DirecTV Group, Inc., DirecTV Holdings, LLC, DirecTV Enterprises, LLC, DirecTV Operations, LLC, DirecTV, Inc., and Hughes Network Systems, Inc., jointly and severally, the total sum of $103,920,250.25, plus prejudgment interest at the agreed rate of 6%, calculated as stated on the record at the July 6, 2006 hearing, on the damages found by the jury, said prejudgment interest totaling $13,359,276.00, together with post judgment interest on the entire sum calculated
    pursuant to 28 U.S.C. § 1961.

    For the reasons stated at the July 6, 2006 hearing, the Court denied Plaintiff’s motion for injunctive relief and granted a compulsory license. Defendants are hereby ORDERED, for the remaining life of the ` 505 patent, to pay Plaintiff an ongoing royalty of $1.60 per Integrated Receiver Decoder, commonly referred to as a set top box, activated by or on behalf of or for any of the named Defendants or their present or future affiliates or subsidiaries after June 16,2006. Royalties shall be paid quarterly accompanied by a statement in accordance with the provisions of paragraph 3.8 of the MPEG-2 Patent Portfolio License, dated February 22, 2001, granted to Hughes Network Systems, Inc. Payments shall begin three months after the date of signing of
    this judgment and shall be made quarterly thereafter. Payments not made within 14 days of the date due shall accrue interest at the rate of 10% , compounded monthly. Finisar shall have the right to request audits in accordance with the provisions of paragraph 3.9 of said MPEG-2 Patent Portfolio License. It is anticipated that, as sophisticated entities with experience in licensing
    agreements, the parties may wish to agree to more comprehensive or convenient terms. The
    parties shall promptly notify the court of any such agreement. The court maintains jurisdiction to enforce this portion of the Final Judgment.

    Costs are taxed against Defendants The DirecTV Group, Inc., DirecTV Holdings, LLC,
    DirecTV Enterprises, LLC, DirecTV Operations, LLC, DirecTV, Inc., and Hughes Network
    Systems, Inc. jointly and severally. All relief not specifically granted herein is denied. All pending motions not previously ruled on are denied. This is a Final Judgment and is appealable.

    Finisar gets larger patent infringement award

    Finisar Corp. said Friday it was awarded additional post-verdict damages by a federal district court against DirecTV Group Inc. in a patent infringement case.
    In June, Sunnyvale-based Finisar (NASDAQ:FNSR - News), which provides gigabit fiber optic products for high-speed data networks, said a Beaumont, Texas, jury awarded a $78.9 million verdict in back damages to Finisar from El Segundo, Ca.-based DirecTV (NYSE:DTV - News).

    Finisar said the court added another $25 million on Thursday to the damages, and also awarded Finisar prejudgment interest on the jury's verdict in the amount of 6 percent compounded annually from April 4, 1999, which currently totals about $12 million.

    In addition, the court ordered DirectTV to pay a compulsory ongoing license fee to Finisar at the rate of $1.60 per set-top box through the duration of the patent, which expires in April 2012.

    Miller Johnson initates FNSR with an Outperform and $6 tgt saying that their checks are likely to post a solid, albeit largely in line April quarter. Firm believes that some of the upside to the April quarter was limited due to supply constraints of VCSEL lasers. Fim believes that the co is addressing those constraints by bringing on additional reactors and improving production yields. Still, firm expects the supply constraints to persist through at least the end of the year. Firm's Outperform rating is based on FNSR's role as one of the largest supplier of optics for the Storage Area Networking and LAN sector, which are experiencing tremendous growth.

    And this is one of the smaller fish.. Agilent also being sued by fnsr for patent infringements.. A lot of smaller companies expected to fall in line there as well once its clear that fnsr will enforce its extensive intellectual portfolio!
